Buying an apartment is not an everyday purchase. To avoid disappointment in a new acquisition before buying a property, you need to pay attention to the following points.
When buying an apartment through a real estate agency - an advance is paid for the apartment. From the moment the advance payment is made, the apartment is withdrawn from sale and is not advertised. The advance payment agreement prescribes the payment plan for the apartment, the timing of the transaction, the terms of the physical and legal release of the apartment, which documents will be presented to the buyers.
If you yourself have found an apartment and communicate with the owner of the object without intermediaries, then a deposit or advance is paid for the apartment, a sales contract is drawn up.
This contract must be signed personally by the owner of the housing, and if there are several owners, then personally by all owners of the housing. When a proxy representative acts on the side of the seller, there is a risk that it may be recalled by the person issuing it. Then the representative will not be an authorized person to conclude a contract of sale of an apartment. Controversial issues can be resolved through the courts, but it can take a lot of time and effort to solve this problem.
You can draw up a simple written form of a contract of sale or a contract certified by a notary. The second option is more reliable. The contract of sale is considered concluded from the moment of its registration in the Unified State Register of Rights!
Upon completion of registration, you will be issued a Certificate of the right to choose property and a registered contract for the sale of an apartment with stamps on registration of the transaction and the right.
Check the spelling of the data in the Certificate, as typos sometimes. The transaction is considered to be registered, and legal obligations that have occurred since the day the transaction was recorded in the Unified State Register of Rights.
